FEDSAS v MEC for Education, Gauteng and Others
The Gauteng Department of Education has introduced a new online system to complement and streamline the admissions application procedure for learners in the Province. FEDSAS has seen the introduction of this system as empowering the HOD to interfere with the admissions process. FEDSAS has also concluded that the GDE has made a decision to convert 124 of its Afrikaans schools to dual medium. After a successful urgent application, FEDSAS is now seeking a review of the HOD’s administrative action of describing the manner in which admissions are not to take place and a review and setting aside of the MEC and HOD’s decision to convert the schools. The EELC is representing Equal Education, which intends to join the matter as amicus curiae (friend of the court), to make submissions supporting the Gauteng Edcuation Department, and emphasising the right of the state to intervene in a school’s language policy to ensure access to education where equity, practicability and the need for redress require that.
